Oregon Labor Laws 2025

Oregon has robust labor protections including a three-tiered minimum wage system, daily overtime for manufacturing, mandatory breaks, and paid sick leave. Portland has additional predictive scheduling requirements.

Minimum Wage

Oregon has a three-tiered minimum wage system based on geographic location, adjusted annually for inflation.

Key Requirements

  • Standard minimum wage: $14.70 per hour (as of July 1, 2025)
  • Portland metro area: $15.95 per hour
  • Non-urban counties: $13.70 per hour
  • No tip credit - tipped employees must receive full minimum wage before tips
  • Annual adjustments based on Consumer Price Index

Overtime

Oregon has both daily and weekly overtime requirements, providing stronger protections than federal law.

Key Requirements

  • Overtime pay: 1.5x regular rate for hours worked over 40 in a workweek
  • Daily overtime: 1.5x for hours worked over 10 in a day (manufacturing only)
  • Seventh-day overtime: 1.5x for all hours worked on the seventh consecutive day
  • Salary threshold for exempt employees: $1,409.60 per week ($73,299.20 annually) in 2025
  • Agricultural workers have specific overtime thresholds

Meal and Rest Breaks

Oregon requires specific meal and rest periods for all hourly employees.

Key Requirements

  • Rest breaks: 10-minute paid break for every 4 hours worked (or major fraction)
  • Meal periods: 30-minute unpaid meal break for work periods of 6-8 hours
  • Two 30-minute meal breaks for shifts over 8 hours
  • Meal break should start between hours 2 and 5 of the work period
  • Rest breaks cannot be combined or used to shorten the workday

Paid Sick Leave

Oregon requires paid sick leave for all employees working in the state.

Key Requirements

  • Accrual: 1 hour of sick time for every 30 hours worked
  • Minimum of 40 hours per year must be available
  • Employers with 10+ employees: sick time is paid
  • Employers with fewer than 10 employees: sick time may be unpaid
  • Can be used for illness, preventive care, care of family member, or public health emergencies

Predictive Scheduling (Portland)

Portland has predictive scheduling requirements for retail, hospitality, and food service employers.

Key Requirements

  • Applies to employers with 500+ employees worldwide in retail, hospitality, or food service
  • Must provide work schedules at least 7 days in advance
  • Predictability pay required for schedule changes within 7 days
  • Good faith estimate of work schedule required at time of hire
  • Right to rest between shifts (10 hours minimum) with premium pay if violated

Understanding Oregon's Regional Minimum Wage

Oregon uses a three-tier system to account for cost of living differences:

Portland Metro Area - $15.95/hour

Includes Multnomah, Washington, Clackamas counties and portions of Yamhill, Columbia, and Marion counties within the urban growth boundary.

Standard Counties - $14.70/hour

Applies to most other counties including Eugene, Salem, Bend, Medford, and other mid-sized cities.

Non-Urban Counties - $13.70/hour

Applies to 18 rural counties designated as non-urban including Baker, Coos, Curry, Douglas, Gilliam, Grant, Harney, Jefferson, Klamath, Lake, Malheur, Morrow, Sherman, Umatilla, Union, Wallowa, Wheeler, and portions of other counties.
